What cap applies in Turkey?

Under article 344 of the Turkish Code of Obligations, when a lease is renewed the new term's rent cannot rise by more than the change in the 12-month average CPI for the previous rental year. TÜİK publishes the rate monthly. If the contract sets a lower rate, that lower rate applies. The temporary 25% cap ended on 1 July 2024.

Practical tips

  • Pay rent in the manner and period set by the contract and keep bank receipts.
  • Confirm the increase in writing with the other party to reduce later disputes.
  • Commercial leases can have different terms and rules; the tool only does the arithmetic.
  • In a dispute a court can be asked to determine the rent; speak to a lawyer in that case.

Important notice

This tool is not legal advice. The applicable rate and procedure depend on your contract, current law and the specific case.

Frequently asked questions

How is a rent increase calculated?

New rent = current rent × (1 + rate ÷ 100). For example a 30% increase on a rent of 20,000 gives a new rent of 26,000.

Is there a cap on residential rent increases in Turkey?

Yes. Under article 344 of the Turkish Code of Obligations the rent for a renewed term cannot rise by more than the change in the 12-month average CPI. Get the current rate from the official TÜİK data.

What if the contract rate is lower than CPI?

If the contract sets a lower increase, that lower rate applies; CPI only sets the ceiling. Read your contract carefully.

Does the 25% cap still apply?

The temporary 25% cap ended on 1 July 2024; the current rule is the CPI-average cap in article 344. Laws can change, so check current legislation or ask a lawyer.
